For over 30 years, Cavitch has had a vibrant practice in the area of title insurance law and related fields. Cavitch has represented several of the major title insurance carriers in a variety of cases dealing with various aspects of title insurance claims, coverage and related issues. The types of cases have ranged from major class action litigation to more routine types of claims. We have defended and litigated claims on a variety of topics, including equitable subrogation, lien priority, access issues, boundary and encroachment issues, adverse possession mortgage foreclosure issues, bankruptcy-related issues, and many others. We have also represented title insurance carriers in connection with defalcations by title agents, and recoupment claims against third parties.
The title insurance area is a corollary to our Real Estate Practice Group in which we represent a variety of developers and property owners. There is a direct overlap between the Real Estate Practice Group and the Title Insurance Practice Group. We have specialists in both the litigation aspects of title insurance disputes and in the substantive area of real estate law.
