We get to pick our friends. We do not get to pick our relatives. Unfortunately, the death or mental incompetence of a family member can lead to contentious issues among the members of a family. Anger and distrust are common and go hand in hand. Controversy may happen in a Will contest challenging the legality of the Last Will and Testament of a deceased person or a court battle when one person disagrees with how another person is handling the finances of an incompetent family member and alleges breach of a fiduciary duty.

Disputes over trust administration are more common with family members challenging how trust money for a relative is being managed and spent. These persons may be looking out for the interests of the trust beneficiary, their own interests as successor beneficiaries or both.
